West Virginia Minor Child Power of Attorney Form

The West Virginia minor child power of attorney form is a document that is completed by Parent(s) or a Court Appointed Guardian that would provide temporary powers for a temporary custodian, to care for a child or children while the parent(s) or court appointed guardian are temporarily absent. This document must show signatures of two witnesses and all signatures must be witnessed by a licensed notary. Should the parent(s) or guardian find that the acts provided by the temporary custodian are no longer required, they may revoke the document in writing delivered to the temporary custodian.

  • Name(s) of the child(ren)
  • Relation to the child(ren)
  • Street address

  • State

Step 3 – Delegation of Powers –

  • Check the box that best indicates powers required for the child(ren)
  • If checking “B” – enter the limited powers authorized
  • Date of commencement of the document in dd/mm/yy format
  • Check the box that best indicates when the document should commence

Step 4 – Signatures – Enter:

  • Parent(s)/Court Appointed Guardian(s) Signature(s)
  • Printed name(s)
  • Date signature(s) in mm/dd/yyyy format

Step 5 – Acceptance by Attorney In Fact (Temporary Custodian)

  • Review the acceptance statement
  • Attorney In Fact (Temporary Custodian) signature
  • Print name
  • Date signature in mm/dd/yyyy

Step 6 – Affirmation by Witnesses –

  • Enter the witnesses name(s) at the beginning of the paragraph
  • Witnesses respective signatures
  • Printed names
  • Date the signatures in mm/dd/yyyy format

Step 7 – Notary Acknowledgement –

  • When the notary has witnessed all signatures, the notary will complete the remainder of the form with all required information, finally affixing the official seal.
