Wisconsin Durable Financial Power of Attorney Form

The Wisconsin durable financial power of attorney form is a legal document that allows a Principal to appoint an Agent to make all financial decisions for them pertaining to bank and any other financial accounts, personal property and real property. No powers will be granted for this Agent to make any health care decisions. The Principal may wish to review this document by consultation with an attorney to ensure that their rights will be properly protected. The document will require the presence of all signatories before a notary. The form may be revoked at the complete discretion of the Principal at any time they so desire.

How to Write

Step 1 – Introduction –

  • Principal must download the document and review the first two pages of the instrument, prior to completion

Step 2 – Designation of Agent – Submit the following:

  • Principal’s name
  • Name of Agent
  • Address
  • Telephone number

Step 3 – Designation of Successor Agent(s) (optional) – In the event the initial agent cannot serve:

  • Name successor agent
  • Address
  • Telephone number
  • AND
  • Name of second successor
  • Address
  • Telephone number

Step 4 – Granting of Authority – Provide:

  • Initial any of the boxes indicating the powers the Principal wishes to grant to the Agent
  • Any powers denied should be left blank

Step 5 – Limitations on Agent’s Authority –

  • Principal must read the statement provided
  • Enter any special instructions the Principal would like to direct into the box provided

Step 6 – Effective Date –

  • Document will become immediately effective unless a specific date is stated in the special instructions

Step 7 – Nomination of Guardian – Provide the following information:

  • Should a court find that guardian be appointed, enter the name person the Principal wishes to nominate for the estate
  • Address
  • Telephone number
  • AND
  • Enter the name of a nominee for guardian over the Principal’s person
  • Address
  • Telephone number

Step 8 – Reliance on Powers – Read the statement and submit Principal’s information in service of a notary:

  • Principal’s signature
  • Date of signature
  • Printed name
  • Address
  • Telephone number

Step 9 – Notarization –

  • The notary shall witness the Principal’s signature
  • The notary will provide all remaining information and affix the official seal

Step 10  – Agent Information –

  • Agent must review all information
  • ‘After statement (4) enter the Principal’s name and the Agent’s signature
  • Read “Termination of Agent’s Authority”
  • Review “Liability of Agent”
  • Agent’s signature
  • Date the document in mm/dd/yyyy format

Step 11 – Agent’s Certification – (Optional)

  • If the Principal would like to have all Agent information on file, they may have the Agent(s) complete the Certification and have it witnessed by a notary
