Utah Minor Child Power of Attorney Form

The Utah minor child power of attorney form is a legal document that would be issued by a Parent or Court Appointed Guardian, so that someone else may be allowed temporary guardianship for the benefit of the child(ren) that they may be properly cared for in the absence of the parent(s) or court appointed guardian.

The document has the capability of full functionality with regard to the care of the children, or it may be limited with regard to powers. The document will not allow any temporary guardian to sign for a minor child to marry nor would they be allowed to sign for the adoption of any child in their care,

Signatures to this document must be submitted only before a licensed Notary Public. This document may be revoked at any time by the parent(s) or court appointed guardian. Notice must be in writing, notarized and delivered or served to the temporary guardian. The notice is not effective until the temporary guardian has received the revocation notice.

How to Write

Step 1 – Children’s Information – The parent(s) or Court Appointed Guardian must indicate their relation to the child(ren) by selection of one of the two options provided:

  • Parent
  • Court Appointed Guardian

Child(ren) – If there will be more  than one child in the care of the temporary guardian, add the children’s information on a separate sheet. Be certain to date and sign the added sheet prior to attaching it to the document – Enter the following:

  • Name(s) of the Child(ren)
  • Date of Birth for the child(ren) in mm/dd/yyyy format

Step 2 – Appointment of Temporary Guardian – Submit the following information:

  • Temporary Guardian’s Name
  • Address
  • City, State, Zip Code
  • Phone Number
  • Email Address

Step 3 – Selection of Powers Options – The parent(s) or Court Appointed Guardian must select only one of the following by checking the appropriate box:

  • Delegate all powers over the children
  • Delegate Limited Authority (in which case, the specific powers must be clearly stated on the lines provided on the form)

Step 4 – Date of Expiration –

  • Enter the date of expiration of the document in mm/dd/yyyy format. This expiration must occur within a six (6) months time frame
  • Check the box if the powers will continue if the parent(s) or Court Appointed Guardian should become disabled

Step 5 – Signature – Must be provided in the presence of a Notary Public –

  • Date the signature in mm/dd/yyyy format
  • Parent or Court Appointed Guardian must enter their signature before a Notary
  • Enter the printed name of the Parent or Court Appointed Guardian
  • Address
  • City, State, Zip Code
  • Email Address

Notarization-

  • As the signature and information is entered and witnessed by the Notary Public, the Notary will complete the remainder of this section in acknowledgement, by provision of the required notary information and affixing the official seal
