New Jersey power of attorney forms are varied and serve different purposes. The most common documents are those, where a Principal would appoint an Agent who would care for their finances, property, and/or person when they are no longer able to carry out their own decisions due to incapacity. There are also powers of attorney that are limited and short-term, such as tax powers granted to a business entity or individual or vehicle transaction powers, as examples.

Regardless of the type of powers document, they will all authorize powers to another person in the absence of the Principal. How limited or extensive the respective document is entirely up to the Principal and the Agent is required to follow the instructions, as if the Principal were present to make all of their own decisions, business, and health.

State Definition – Revised 46:2B-8.2 “A power of attorney is a written legal document that authorizes (allows) another person to act on your behalf in matters of finance, property, business, or legal affairs. In this written document, you are known as the principal and the person you authorize to act on your behalf is known as the agent or attorney-in-fact. Often, people refer to the agent or attorney-in-fact informally as the POA, but that is not a legal term.”
