North Dakota Minor Child Power of Attorney Form

The North Dakota minor child power of attorney form is a document that is designed to permit a parent the ability to select an Agent/Guardian, to care for their child(ren) during the parent(s) extended absence or illness. This document provides permission for the Guardian to offer the best possible care for the child(ren) while their parents are away. This document will provide permission to place the child(ren) in school, participate in school activities, provide permission to sign for medical and dental care (and other forms of physical care), in a preventative or in an emergency situation.

The Guardian(s) should make decisions for the children as if their parent(s) were present to make their decisions for them on their own.

This document must be signed before a notary public. This document may, at any time, be revoked in writing and by service or delivery to the Agent/Guardian(s).

How to Write

Step 1 – Parent and Children Information – Enter the following:

  • Check the field that describes your relation to the child(ren)
  • Enter the name(s) of the child(ren)
  • Provide the child(ren’s) dates of birth
  • Provide the caregiver’s street address
  • City, State and Zip Code

Step 2 – Appointment of Guardian –

  • Guardian’s name
  • Street Address
  • City, State and Zip Code
  • The parent(s) and guardian(s) must read paragraphs A through D for specifics with regard to the care of the child(ren)
  • The parent(s) must enter the authorities that are excluded in the lines provided
  • The document may only remain in effect for no longer than six (6) months – Enter the termination date of the document in mm/dd/yyyy  format

Step 3 – Signature and Notarization-

  • Provide the date of the parent(s) signature in dd/mm./yyyy format
  • Enter the parent(s) signature
  • Type or print parent(s) name(s)
  • Enter the parent’s street address
  • City, State and Zip Code

Notarization –

Upon completion and signature witnessed by the Notary Public, the notary will acknowledge the document by completing the remaining portion of the document.
