Maryland Power of Attorney –As defined in Law: MD Estates & Trusts §§17-101, 17-202, 17-203  17-204 – A power of attorney is a document whereas an individual, provides another person legal authority to act for the Principal. It allows a person (Principal) to designate someone else (Agent) to make decisions for them in the event they are unable to make decisions for on their own for any reason. The powers document will allow the Principal to define the limits of the powers allowed by the Agent. These powers shall not take away the principal’s power to act on their own behalf as long as they are able; it will only grant the Agent the power to also act for the Principal.

State Definition – According to MD Estates & Trusts §§17-101, 17-202, 17-203  17-204 – A powers document is “Any writing or other record that grants authority to a person to act for someone will be read as a power of attorney, even if the document does not say “power of attorney” on it. The Maryland General and Limited Power of Attorney Act created a specific kind of power of attorney called a “statutory form power of attorney.” These are documents that are the same or similar to the powers of attorney forms included in the law.”
