Massachusetts General Financial Power of Attorney Form

The Massachusetts general financial power of attorney form is a document that will provide the ability to appoint an Agent, by the Principal, to make unlimited decisions with regard to the financial aspect of the Principal’s estate. Although the powers would be implemented upon completion of the document, the Principal will not give up their rights to authorize actions with regard to their accounts or any part of their finances (money). The Agent should also be aware that the document will not remain in effect should the Principal become incapacitated in any way.

This document will offer the opportunity for the Principal to impose limitations and restrictions upon the Agent. This document will require attestation by two witnesses and the acknowledgment of a Notary Public. The Principal may revoke this document at any time.

How to Write

Step 1 – Download the document –

  • The Principal must begin by reviewing the following titles
  • Notice
  • Incapacitation
  • Revocation
  • Witness and Notary

Step 2 – Principal’s Information –

  • Enter the Principal’s Name
  • Street Address
  • City
  • State
  • AND
  • The name of the Agent/Attorney In Fact
  • Street Address
  • City State
  • Enter the state in which the document will be utilized
  • AND
  • Nae of the Successor Agent (in the event the initial agent is unable to serve)
  • Street Address
  • City
  • State
  • Enter the state where the document will be utilized

Step 3 – Additional Titles – to be carefully reviewed by the Principal:

  • Terms and Conditions
  • Third Parties
  • Compensation
  • Disclosure

Step 4 – Signatures – Must be signed before a notary:

  • Printed Name of Principal
  • Date of signature in dd/mm
  • Read the remainder of the paragraph
  • Enter the Principal’s Signature
  • AND
  • Agent’s Printed Name
  • Signature of Agent
  • Date of Signature in mm/dd/yyyy format
  • AND
  • Successor Agent’s Printed Name
  • Signature of Successor Agent
  • Date of Signature in mm/dd/yyyy format

Step 5 – Notary Acknowledgement –

The Notary Public will witness all of the signatures. They will then complete the form by entering all of the state required Notary Information in acknowledgment of the document.

Step 6 – Acknowledgement and Acceptance of Appointment by the Agents – The next two paragraphs will ask that the Agents Accept their appointment, enter the following:

  • Enter the Agent’s printed name
  • Signature of the Agent
  • Date the signature in mm/dd/yyyy format
  • AND
  • Enter the Successor Agent’s printed name
  • Signature of Successor Agent
  • Date the signature in mm/dd/yyyy format
  • AND

Witness Attestation – Both witnesses must review the paragraph provided, if in agreement, provide the following:

  • Printed names of the witnesses
  • Signature of each witness
