Limited power of attorney, or sometimes referred to as a “special”, is a document that allows a person to give a specific designation to another to conduct an act to their benefit. This is commonly used with items such as accepting mail on someone else’s behalf although the document may be used for any type of designation and can be structured so that it is used for a temporary or indefinite amount of time. To have the form prepared it should be completely filled-in with the Agent (or referred to as the Attorney-in-Fact) present and it should be signed in the presence of a notary public (if applicable by State law).
Real Estate Power of Attorney – This form is primarily used for property transactions. The limited form may be used as well but the real estate form is most appropriate.

How to Write

Step 1 – Parties – Provide the following:

  • Principal’s full name
  • Social Security Number (SSN)
  • AND
  • Name of Attorney In Fact/Agent
  • Address
  • Phone number

Step 2 – Limited Powers – Enter into the lines provided:

  • Specify the limited powers in which the Agent will have the authority to undertake on behalf of the Principal
  • Review the remainder of this section

Step 3 – Revocation –

  • Principal may indicate their preference for revocation of the document by initialing and checking one of the options (if a specific date is preferred, enter the date in dd/m/yy format
  • Provide the state in which the document would be governed

Step 4 – Signatures – Submit the following information:

  • Date the signature in dd/m/yyyy format
  • Principal’s signature
  • Printed name

Step 5 – Acceptance of Appointment – Provide:

  • Agent’s name
  • Agent’s signature
  • Printed name

Witnesses – Must enter the following:

  • Witnesses signatures
  • Printed name
  • Address
  • City, State, Zip Code

Step 6 – Notarization –

  • A notary public shall witness all signatures
  • Once the signatures are witnessed the notary shall complete the document in acknowledgement of the validity of the document
