Idaho Real Estate ONLY Power of Attorney Form

The Idaho real estate only power of attorney form is a document used by a Principal to delegate powers to an Agent to oversee the care, management, sale, purchase or refinancing of the Principal’s real property. The Agent would be responsible to do business with the Principal’s property as if they were available and able to attend to their own affairs. This document must be notarized. The form may be revoked at any time should the Principal wish to end the powers to the Agent.

How to Write

Step 1 – Parties –

  • Name of the Principal
  • The Street Address
  • City
  • State
  • AND
  • Name of the Agent
  • Their Street Address
  • City
  • State

Step 2 – Article I – Assignment of Authority – Initial any or all of the of the powers that

  • Sale of Real Estate
  • Purchase of Real Estate
  • Management of Real Estate
  • Refinancing

Step 3 – Article III. Term – Select and Initial one (1) of the terms in which the document will become effective and when it will terminate (If applicable:

  • This power would make the document effective as of the date stated and would expire automatically on the date entered, in dd/mm/yyyy format
  • If the non-durable option is selected, the document will be immediately effective and will only terminate if the Principal become incapacitated
  • Should the durable option be selected, the document would become immediately available and would only terminate upon the Principal’s death

Step 4 – Article VI – Revocation – Signatures – Provide the following information before a Notary Public:

  • Enter the date that the document had been executed in dd/mm/yyyy format
  • The Principal’s Signature
  • Printed Name
  • AND
  • The Agent’s Signature
  • Printed Name
  • AND (OPTIONAL)
  • Witnesses (if any) Signatures
  • Printed Names

Once the Notary has identified all signatories, the notary will witness all signatures. The Notary will then complete the required information acknowledging the document
