Hawaii Real Estate ONLY Power of Attorney Form

The Hawaii real estate only power of attorney form is a document that is used by a Principal so that, in the event of illness or absence, they may designate an Agent to handle business transactions, sales, purchases, refinancing or management of their real property, that may be necessary. An Agent may be an individual business that works with real property. The Principal may choose the powers that they would wish to grant to an Agent. This document may be revoked at the discretion of the Principal. Signatures to this document must be witnessed by a Notary Public.

How to Write

Step 1 – Parties –

  • Enter the name of the Principal
  • Street Address

  • AND
  • Enter the name of the Agent
  • Street Address

  • State

Step 2 – Article I – Assignment of Authority – Initial any or all of the of the powers to granted to the Agent

  • Sale of Real Estate
  • Purchase of Real Estate
  • Management of Real Estate
  • Refinancing

Step 3 – Article III. Term – Select and Initial one (1) of the terms in which the document will become effective and when it will terminate (If applicable:

  • Selection of this power would make the document effective as of the date stated and shall expire automatically on the date stated, in dd/mm/yyyy format
  • If the non-durable option is selected, the document will be immediately effective and will only terminate should the Principal become incapacitated or upon revocation
  • If the durable option selected, the document would become immediately available and will only terminate upon the date of the Principal’s death

Step 4 – Article VI – Revocation – Signatures – Provide the following information before a Notary Public:

  • Enter the date that the document had been executed in dd/mm/yyyy format
  • Principal’s Signature
  • Printed Name
  • AND
  • Agent’s Signature
  • Printed Name
  • AND (OPTIONAL)
  • The Witnesses (if any) Must Read the Affirmation
  • Witnesses Signatures
  • Printed Names

Once the Notary has identified all signatories, the notary will witness all signatures. The Notary will then complete the required information acknowledging the document.
