Colorado Real Estate ONLY Power of Attorney Form

The Colorado real estate only power of attorney form is a document that is completed by a Principal owner/title holder of real property. In the event of illness or absence, the Principal may wish to delegate powers to an Agent. The Agent would then take over the care and business involving the assigned real property only. Although not explicitly stated in law, following all other POA requirements and accounting for recording, this document must be attested by a Notary Public. This document may also be revoked by the Principal at any time.

How to Write

Step 1 – Principal’s Designation of an Agent – Provide the following:

  • Principal’s Name
  • Physical Address
  • State
  • AND
  • Agent’s Name
  • Physical Address
  • State

Step 2 – Article I – Assignment of Authority – Principal may select one or all of the following powers they wish to implement for use by the Agent on their behalf:

  • Sale of Real Estate
  • Purchase of Real Estate
  • Management of Real Estate
  • Refinance of Real Estate

Step 3 – Article III – Term – The Principal shall establish the term from the following options:

  • The Principal may select a commencement and termination date
  • Non-durable option, the document becomes immediately available and only ends if/when the Principal becomes disabled or incapacitated
  •  The durable option – the terms will begin immediately and shall terminate only upon the death of the Principal

Step 4 – Article VI  – Revocation –Validation of the document will be in order once all signatories have provided their information and signature befor a Notary:

  • Date the signatures in dd/mm/yyyy format
  • The Principal’s Signature
  • Print the Principal’s Name
  • AND
  • Agent’s Signature
  • Printed name of the Agent
  • AND (OPTIONAL)
  • Witnesses Signatures
  • Print the Names of Witnesses
  • AND

Once completed all parties who shall sign in the agreement must appear before a Notary Public. The Notary will witness all signatures and complete the remainder of the document affixing the official Notary Seal.
