Arkansas Real Estate ONLY Power of Attorney Form

The Arkansas real estate only power of attorney form is a document that provides written permission for a Principal to grant to a selected Agent for the purpose of caring for their real property, transactions of any kind, in their absence. This document will require the acknowledgment of a Notary, and witnesses may be present to protect the document’s execution further.

How to Write

Step 1 – Principal Shall Designate an Agent– Provide

  • Name of the Principal
  • Physical address
  • State
  • AND
  • Name of the Agent
  • The Agent’s Physical Address
  • State

Step 2 – Article I – Assignment of Authority – The Principal must the appropriate powers they would choose to grant to their Agent. Select one or all of the options. The Principal must initial and check all of the following box(es) that apply:

  • Sale of Real Estate
  • Purchase of Real Estate
  • Management of Real Estate
  • Refinance of Real Estate
  • Principal must read Article II

Step 3 – Article III – Term – Establishment of Terms:

  • Select a fixed beginning and termination date
  • Non-durable option, the document is immediately available and shall only end if the Principal becomes disabled
  • If the Principal selects the durable option, the terms will commence immediately and will only terminate upon the Principal’s death

Step 4 – Article VI  – Revocation –Parties who sign the document must appear before Notary Public. Complete the section as follows:

  • Date the signatures in dd/mm/yyyy format
  • Enter the Principal’s signature
  • Enter the Printed name of the Principal
  • AND
  • Enter the Agent’s signature
  • Agent’s Printed Name
  • AND (OPTIONAL)
  • Witnesses Signatures
  • Witnesses Printed Names
  • AND
  • Immediately after the Notary has recorded the identifications of all signatories, shall they acknowledge the document by completing and signing the required Notary section and providing the official seal
